G&D Integrated Under Investigation For More Than 100 Unfair Labor Practices (ULPs)

“Unfair labor practice” refers to an action which violates relevant employment legislation regarding a transgression carried out by an employer. This legislation is part of the National Labor Relations Act (NLRA) and ULPs are investigated by the National Labor Relations Board (NLRB).

25-CA-285010 On or around October 20, 2021, Company Supervisors retroactively assessed attendance points to Union Supporter in retaliation for his support of the Union. 

25-CA-285011 On or around October 21, 2021, union supporter was given a written warning for a work defect caused by another worker. The employer has not issued warnings to non-supporters who have caused defects. 

25-CA-285015 On or around October 20, 2021, Company Supervisors retroactively assessed attendance points to Union Supporter in retaliation for his support of the Union.

25-CA-285044 After telling the bargaining unit that there will be no more overtime work, Company Supervisor then permitted anti-union workers to perform overtime in job duties regularly performed by union supporters.  

25-CA-285048 On or around October 20, 2021, Company Supervisor began criticizing the work quality of union supporters despite the fact that he had previously praised their production efforts.  

25-CA-285141 On or around October 12, 2021, Company Supervisor told Union Supporter that if the workers voted to unionize, the owner would close the facility.  

25-CA-285145 On or around October 22, 2021, Company Supervisor performed bargaining unit work (driving a forklift) while members of the bargaining unit were looking for work to perform. 

25-CA-285157 On or around October 22, 2021, Plant Manager performed bargaining unit work (operating a machine called the fadal) while members of the bargaining unit were looking for work to perform.  

25-CA-285167 On or around October 22, 2021, Company Supervisor directed union supporters not to leave their work stations prior to 3:30 p.m. but allowed anti-union workers to do so.  

25-CA-285170 On or around October 22, 2021, Company Supervisor tampered with the settings of a machine called the fadal so that its operator, Union Supporter, would damage the machine. 

25-CA-285174 On or around October 22, 2021, Company Supervisor unilaterally modified the attendance policy by changing when attendance points would be assessed.  

25-CA-285181 On or around October 22, 2021, Company Supervisors surveilled employees as they were working. 

25-CA-285287 On or around October 25, 2021, Company Supervisor began unnecessarily criticizing the work of individuals in retaliation for their support of the Union.  

25-CA-285323 On or around October 25, 2021, Company Supervisor performed bargaining unit work (plugging a deck) while members of the bargaining unit were looking for work to perform.  

25-CA-285179 On or around October 22, 2021, the employer has failed to remove the “vote no” signs despite the Union winning the election.  

25-CA-285630 On or around October 29, 2021, the Employer violated the Act by threatening the Union with litigation concerning its G&D Union logo and pro-Union website. 

25-CA-285899 On or around November 3, 2021, Company Supervisor performed bargaining unit work (assembling parts and doors) while members of the bargaining unit were looking for work to perform. On or around November 3, 2021, anti-union worker was permitted to work despite an injury while union supporter was denied light duty.  

25-CA-285898 On or around November 2, 2021, the Employer refused to review the work of Union Supporter so that he could correct any potential defects. 

25-CA-285896, 25-CA-285893 On or around October 29, 2021, Company Supervisor performed bargaining unit work (assembling parts) while members of the bargaining unit were looking for work to perform.  

25-CA-286147 On or around November 5, 2021, Company Supervisor issued Union Supporter a written warning for a production error, despite the fact he had previously fixed the issues.  

25-CA-286133 On or around November 5, 2021, Company Supervisor Union Supporter’s request for Union representation during an investigatory interview.  

25-CA-286397 Previously, the Union filed a charge because the Employer scrapped the work of Union Supporter in retaliation for supporting the Union. On or around November 9, 2021, Company Supervisor issued discipline in retaliation for the prior unfair labor practice charge.  

25-CA-286409 The Employer terminated Union Supporter in retaliation for his support of the Union. 

25-CA-286416 The Employer assessed attendance points against Union Supporter for an absence. This absence would not have merited a point deduction under the Employer’s previous enforcement of its attendance policy.  

25-CA-286418 On or around November 11, 2021, Company Supervisor disciplined Union Supporter for production errors. Union Supporter’s conduct would not have warranted discipline under the Employer’s previous enforcement of its production rules. 

25-CA-287972 On or around November 23, 2021, Company Supervisor engaged in unlawful surveillance of the bargaining unit by requiring workers to move weld curtains and blueprint boards so that he can watch them.  

25-CA-287988 On or around November 23, 2021, Company Supervisor interrogated Union Supporter about the unfair labor practices filed by the Union and told him that the charges need to stop.  

25-CA-289948 On February 2, 2022, the Employer refused to continue negotiating an initial collective bargaining agreement, claiming that further negotiations were futile. The Union seeks 10(j) relief.
